Annual General Meeting (AGM) – Due Dates for Housing Societies in Maharashtra (FY 2019–20 to 2024–25)


Under the provisions of the Maharashtra Co-operative Societies Act, 1960, particularly Section 75(1), every Co-operative Housing Society in Maharashtra is mandatorily required to hold its Annual General Meeting (AGM) within the prescribed time limit.

Normally, the AGM must be held on or before 30th September following the close of the financial year (which ends on 31st March).

However, due to extraordinary circumstances (COVID-19 pandemic), the Maharashtra Government granted extensions for certain financial years.

AGM Due Dates – Year Wise Position

🔹 FY 2019–20

  • Original Due Date: 30/09/2020

  • ✅ Extended up to: 31/03/2021

🔹 FY 2020–21

  • Original Due Date: 30/09/2021

  • ✅ Extended up to: 31/03/2022

🔹 FY 2021–22

  • Original Due Date: 30/09/2022

  • ✅ Extended up to: 31/12/2022

🔹 FY 2022–23

  • AGM Due Date: 30/09/2023

  • ❌ No Extension Granted

🔹 FY 2023–24

  • AGM Due Date: 30/09/2024

  • ❌ No Extension Granted

🔹 FY 2024–25

  • AGM Due Date: 30/09/2025

  • ❌ No Extension Granted

⚖️ Important Legal Position

Every Housing Society must conduct its AGM:

On or before the extended due date declared by the Government OR 30th September after the close of the financial year — whichever is earlier.

If the Society fails to hold the AGM within the prescribed/extended time:

1. Committee Loses Legal Authority

The Management Committee does not have the legal right to convene and conduct the AGM after the due date on its own.

2. Mandatory Application to Registrar

The Society must submit an application to the Deputy Registrar / Assistant Registrar of Co-operative Societies requesting:

  • Appointment of an Authorised Officer

  • To convene and conduct the overdue AGM

3. Breach of Law & Bye-laws

Failure to hold AGM within time amounts to:

  • Violation of Society Bye-laws

  • Breach of Section 75(1) of the Maharashtra Co-operative Societies Act, 1960

4. May be Disqualification of Committee Members

If Any member filed complaint to the Deputy Registers then The Committee Members and/Or Office Bearers may be:

  • Disqualified for a period up to 5 years
  • Held responsible for statutory default

📝 Conclusion

All Co-operative Housing Societies in Maharashtra must strictly adhere to the AGM due dates. After FY 2021–22, no general extensions have been granted. Therefore, Societies must conduct their AGM on or before 30th September every year, failing which serious legal consequences may follow.

If required, legal recourse can be initiated before the appropriate Registrar authority against defaulting committees.
